At the beginning of the new millennium the former “red-green” coalition government in Germany elaborated and propagated a master plan for the future management of household wastes in Germany.
It was based on five milestones that contain the following goals:
The direct tipping of untreated household waste on landfills for municipal solid waste (MSW) should be stopped as soon as possible, using already existing and also developing new waste-pretreatment techniques and facilities.
For the pretreatment of household waste (MSW) waste incineration but also reliable mechanical- biological-pretreatment (MBT) techniques should be conceded. The legal requirements for these MBT-facilities are to be included in existing environmental laws and regulations (e.g., TA Siedlungsabfall and 17. BlmSchG).
The high calorific fractions from MBT-plants have to be utilized for energy recovery. Plastics and other refuse derived fuel (RDF) must be separated out of residual waste and should be co-incinerated in power stations and other industrial boilers that can meet the strict emission limits of 17. BlmSchV.
Landfills that cannot be technically upgraded to state of the art by reasonable investment have to close down step by step. The construction of new landfills for MSW is not necessary, as the capacity of the adapted landfills is considered to be enough for the next twenty years, as long as suitable waste pretreatment techniques are applied.
Latest by the year 2020 the waste treatment technology should have reached such a high level where all the MSW in Germany totally can be utilized, recovered and/or recycled in an environmentally sound manner, rendering any further landfilling of MSW unnecessary.

Like all public international law treaties, the Paris Climate Accords rely on national law for their implementation. The success of the agreement therefore depends, to a large extent, on the stepstaken or not taken by national governments and legislators as well as on the instruments and mechanisms chosen for this task. Against this background, the present article compares different approaches to the implementation of the Paris Agreement, using court decisions as a means to assess their (legal) effectiveness.
