Under international maritime law, the seabed is covered by both UNCLOS and the Convention on the Continental Shelf. The dumping (injection) of CO2 into the seabed is not prohibited under these conventions. The London Protocol has expressly permitted this since 2006.
In the EU, the CCS Directive provides the legal framework for CO2 dumping. This contains numerous regulations (storage register, etc.) that are of a spatial planning nature. The MSP Directive makes it clear that spatial planning must also be carried out in the sea subsoil. Although German spatial planning law is geared towards the subsoil there has yet been no comprehensive subterranean spatial planning either on land or at sea. In the upcoming update of the EEZ spatial development plan, the spatial planning regulations for CO2 storage must now be laid, not least against the background of the German CCS Strategy 2024. The spatial planning instruments available in the Spatial Planning Act (ROG) have already been found to be applicable to the subsoil. In terms of spatial planning, new methods also need to be used, in particular the so-called use of storeys and 3D cubic metre planning. The required SEA must also be methodically upgraded for the subsoil. The precautionary principle requires an overall planned approach that serves to meet the needs of future generations.
