Beschränkung auf die betroffene Öffentlichkeit?
The deficits in the implementation of public participation in immission control licensing procedures have recently also become apparent in the licensing procedure for the "flagship project" Tesla-Gigafactory. This article provides an overview of the international and European legal framework for public participation in licensing procedures with environmental relevance. Building on this, the Bundesrat initiative of the State of Lower Saxony to limit public participation to the affected public in immission control licensing procedures and other reform options are discussed.
