The Mediterranean Sea is a recognised hotspot of marine biodiversity. Its protection and restoration, including that of its stocks of wild fish, shellfish and mollusca, is urgently needed. With the declaration by France and Italy of ecological protection zones in the western Mediterranean Sea, the zonation of the basin became even more fragmented and unclear than it had previously been. This calls into question whether these zones are suited to their task and their compatibility with the United Nations Convention on the Law of the Sea (UNCLOS). The paper is split into two parts. In the first part the interplay of UNCLOS with the regional Barcelona Convention system is discussed. Against this background, the establishment of marine protected areas (MPAs) and their legal effect is described. The authors examine thoroughly the establishment of MPAs. The second part of the contribution, dealing with the legal regime of the exclusive economic zone, will be published in the next volume of EurUP.
